Terms and Conditions
§1 Applicability to entrepreneurs and definitions (1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of ordering.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity (§ 13 German Civil Code).
§2 Conclusion of contract, storage of the contract text (1) The following regulations regarding the conclusion of a contract apply to orders placed through our online shop at ricecards.de.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely an invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding offer by successfully completing the order process provided in our online shop.
The order process includes the following steps:
Selection of the desired goods
Confirmation by clicking the “Order” button
Review of the information in the shopping cart
Clicking the “Checkout” button
Logging into the online shop after registration and entering the login details (email address and password).
Review or correction of the respective entered data.
Binding submission of the order by clicking the “order with obligation to pay” or “buy” button
The consumer can return to the webpage where the customer’s details are collected and correct input errors before submitting the order by using the “Back” button contained in the internet browser used by him or her, or by canceling the order process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email (“Order Confirmation”). With this, we accept your offer.
(5) Storage of the contract text for orders via our online shop: We will send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at ricecards.de/terms-and-conditions/ . For security reasons, your order data is no longer accessible via the Internet.
§3 Prices, shipping costs, payment, due date (1) The prices stated include the statutory value-added tax and other price components. Any shipping costs are added.
(2) The consumer has the option of payment by direct debit, PayPal.
§4 Delivery (1) Unless otherwise stated in the product description, all items offered by us are ready for immediate dispatch. Delivery will be made within 5 working days at the latest. The deadline for delivery begins on the day following the payment order to the bank instructed with the transfer, or in the case of other payment methods, on the day following the conclusion of the contract. If the deadline ends on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.
(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer in the case of a sale by mail order upon delivery of the item to the buyer.
§5 Reservation of title We reserve ownership of the goods until the purchase price has been paid in full.

Consumers have a right of withdrawal in accordance with the following provisions, whereby consumers are any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity:

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery charges, without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. The shipping costs for the seller will be retained.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You bear the immediate costs of returning the goods.
No right of return or withdrawal for pre-orders!
In accordance with § 312g (2) of the German Civil Code (BGB), the right of withdrawal does not apply to goods whose market value is subject to particularly strong fluctuations.
It is therefore strongly recommended to pre-order products only if you are absolutely certain that you want the product at that price.

§8 Warranty The statutory warranty regulations apply.

Withdrawal policy B2B
Orders in the B2B sector are reserved exclusively for traders and business owners.
Shipping is done via DHL to the agreed delivery address, which can be changed at any time via email. However, personal collection of the goods is also possible by prior arrangement. The costs for shipping are to be paid in addition to the price of the goods and will be listed on the invoice. The value of the goods is always stated gross in the webshop, and the invoice will subsequently contain a separate VAT. Insurance is generally up to €500; if higher insurance is desired, this must be communicated in writing to the seller, who will then calculate the shipping costs including insurance.
Returns and withdrawals of received items and orders are generally excluded. In the case of defective delivery, rectification must be made. Notification of the defect must be made within 24 hours of receipt of the goods. The risk passes to the customer upon handover to the shipping service provider; the seller is not liable for transport
The payment of the invoice amount must, unless otherwise agreed, be made promptly to the specified bank account upon invoicing. Until full payment is received, the goods remain the property of the seller.
We reserve the right to cancel an order in whole or in part or to make an allocation if we are not sufficiently supplied.
B2B orders are usually made on a “Order on Demand” basis. This means that the buyer informs the seller of the desired product + quantity, an invoice is then created for the buyer, and the order is placed with the Japanese dealer only after the invoice is settled. After that, it usually takes 7 – 14 days for the goods to arrive in the Federal Republic. Delays due to customs clearance, etc., can always occur.
Please note that price quotes typically expire after 24 hours due to price volatility.
